sometimes called jury duty, is a legal obligation where you<\/span><b> sit on a trial as a juror to decide whether someone is innocent or guilty of a crime,<\/b><span style=\"font-weight: 400;\"> based on the evidence presented.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Most adults aged under 70 are eligible for jury service, and jurors are selected at random from the electoral register. In other words, for most employers, the bulk of their workforce will be eligible for jury service. Exceptions include:\u00a0<\/span><\/p>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Individuals on are bail for a criminal proceeding<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Previously imprisoned individuals for a length of 5 years or longer<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Anyone who has been sentenced to prison within the last 10 years<\/span><\/li>\n<\/ul>\n<p><span style=\"font-weight: 400;\">H3: Do I have to give my employee time off?<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Employers are required to provide employees with time off if they are called for jury service. Additionally, employers cannot discriminate against an employee for fulfilling jury duty and may face legal consequences if they dismiss an employee for this reason.<\/span><\/p>\n<h2><b>Is Jury Service Mandatory?<\/b><\/h2>\n<p><span style=\"font-weight: 400;\">Yes. If your employee receives a jury summons, they must serve, defer, or ask to be excused (if they have a valid reason). <\/span><b>You can&#8217;t refuse to let them do jury service as it&#8217;s a public duty,<\/b><span style=\"font-weight: 400;\"> and your employee <\/span><b>could face a \u00a31,000 fine or even arrest<\/b><span style=\"font-weight: 400;\"> if they don&#8217;t turn up.<\/span><\/p>\n<h2><strong>How long is jury service?<\/strong><\/h2>\n<p><span style=\"font-weight: 400;\">Jury service typically lasts up to <\/span><b>10 working days,<\/b><span style=\"font-weight: 400;\"> but it could be longer if someone is called for more than one trial or a trial goes on for longer than expected. In Northern Ireland, a jury panel is usually in place for about<\/span><a href=\"https:\/\/www.nidirect.gov.uk\/articles\/time-jury-service\"> <span style=\"font-weight: 400;\">4 weeks.<\/span><\/a><span style=\"font-weight: 400;\"> Your employee will be informed if they will be needed for longer and you can ask them to let you know as soon as they know.<\/span><\/p>\n<h2><strong>Do I have to pay my employee for jury service?<\/strong><\/h2>\n<p><b>You don&#8217;t have to pay employees when they&#8217;re on jury service,<\/b><span style=\"font-weight: 400;\"> but many employers do as a gesture of goodwill. Paying your team members when they are absent due to a legal obligation is a good way to<\/span><b> increase<\/b><a href=\"https:\/\/factorialhr.co.uk\/blog\/6-tools-to-boost-workplace-motivation\/\" target=\"_blank\" rel=\"noopener\"> <b>work motivation<\/b><\/a><b> and job satisfaction<\/b><span style=\"font-weight: 400;\"> as it shows that you care about them.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">If you can&#8217;t pay your employee while they&#8217;re on jury service, they can claim an <\/span><b>allowance for food and travel expenses<\/b><span style=\"font-weight: 400;\"> and <\/span><b>loss of earnings.<\/b><\/p>\n<h2><strong>Can I have my employee defer jury service?<\/strong><\/h2>\n<p><span style=\"font-weight: 400;\">If your employee gets called for jury service at a bad time for your business, you can <\/span><b>ask them to delay their service until a better time. <\/b><span style=\"font-weight: 400;\">You&#8217;ll need to provide them with a <\/span><b>letter explaining why their absence will seriously harm your business.<\/b><\/p>\n<p><span style=\"font-weight: 400;\">But you will have to let them go eventually. Your team members can only delay jury service<\/span><a href=\"https:\/\/www.gov.uk\/giving-staff-time-off-jury-service\"> <b>once in a 12-month period,<\/b><\/a><span style=\"font-weight: 400;\"> and when they reply to their summons they&#8217;ll need to say <\/span><b>when they&#8217;ll be available.<\/b><\/p>\n<h2><b>What is the Procedure if an Employee is Called for Jury Service?<\/b><\/h2>\n<p><b>You have some legal obligations as an employer<\/b><span style=\"font-weight: 400;\"> when one of your team is called for jury service:<\/span><\/p>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><b>You must allow them time off.<\/b><span style=\"font-weight: 400;\"> The law says that all eligible adults must do jury service when called up and there&#8217;s no getting out of it. However, you can ask your employee to take it as<\/span><a href=\"https:\/\/factorialhr.co.uk\/blog\/unpaid-leave\/\"> <span style=\"font-weight: 400;\">unpaid leave.<\/span><\/a><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><b>You can&#8217;t discriminate against your employee for going on jury service.<\/b><span style=\"font-weight: 400;\"> If you pass over them for promotions, decline reasonable holiday requests or dismiss them due to them going on jury service, you could end up in serious trouble.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><b>You could be taken to tribunal<\/b><span style=\"font-weight: 400;\"> if you dismiss an employee for going on jury duty. This could cost thousands of pounds &#8211; probably much more than the team member&#8217;s salary.<\/span><\/li>\n<\/ul>\n<p><b>Jury Duty for Self-Employed<\/b><\/p>\n<p><span style=\"font-weight: 400;\">Jury duty for self-employed individuals works slightly differently. If you&#8217;re self-employed, although you won&#8217;t receive payment during jury service, you may be eligible to claim reimbursement for certain expenses if your income is impacted. During each day of court attendance, you can typically seek:<\/span><\/p>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Up to \u00a364.95 to offset the loss of earnings and cover expenses related to care or childcare beyond your usual arrangements.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">\u00a35.71 for food and drink.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Reimbursement for travel expenses to and from the court.<\/span><\/li>\n<\/ul>\n<p><span style=\"font-weight: 400;\">If the dates in your jury summons don&#8217;t work for you, you can request a postponement.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">For individuals receiving benefits or financial support, promptly inform your benefits office or work coach upon receiving the jury summons. Financial support and benefits, such as Universal Credit, will continue for the initial eight weeks. It&#8217;s best to put together a <\/span><b>jury service policy<\/b><span style=\"font-weight: 400;\"> so everyone knows what to expect should they be called up.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Here are the key elements you need to consider when you&#8217;re constructing your jury service policy:<\/span><\/p>\n<h3><b>Decide what you want to do about pay<\/b><\/h3>\n<p><span style=\"font-weight: 400;\">There are 3 things you can do when it comes to paying employees while they&#8217;re on jury service:<\/span><\/p>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><b>You can decide not to pay them.<\/b><span style=\"font-weight: 400;\"> Make sure you state this clearly near the beginning of your policy. It&#8217;s good practice to <\/span><b>offer advice on how to claim for the loss of earnings allowance.<\/b><span style=\"font-weight: 400;\"> You&#8217;ll need to fill in a<\/span><a href=\"https:\/\/www.gov.uk\/giving-staff-time-off-jury-service\/paying-staff-on-jury-service\"> <span style=\"font-weight: 400;\">certificate of loss of earnings,<\/span><\/a><span style=\"font-weight: 400;\"> which your team member will get with their jury duty letter. Be aware that <\/span><b>some team members may need more help<\/b><span style=\"font-weight: 400;\"> with filling in all the relevant forms than others.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><b>You can top up their loss of earnings allowance.<\/b><a href=\"https:\/\/www.gov.uk\/jury-service\/what-you-can-claim-if-youre-an-employee\"> <span style=\"font-weight: 400;\">As of 2023,<\/span><\/a><span style=\"font-weight: 400;\"> the daily allowance is <\/span><b>up to \u00a364.95<\/b><span style=\"font-weight: 400;\"> plus <\/span><b>\u00a35.71 for food and drink<\/b><span style=\"font-weight: 400;\"> and any<\/span><b> travel costs<\/b><span style=\"font-weight: 400;\"> to and from the courts. To stop your team member from losing out on pay, you can top up this allowance; simply <\/span><b>subtract the court allowance from your team member&#8217;s usual take-home pay, <\/b><span style=\"font-weight: 400;\">then work out the gross amount you need to pay them.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><b>You can pay your employee in full. <\/b><span style=\"font-weight: 400;\">You don&#8217;t need to do anything differently &#8211; work out tax and National Insurance contributions as usual. You <\/span><b>can&#8217;t claim back the money you&#8217;ve paid them<\/b><span style=\"font-weight: 400;\"> or any losses your business has made while your team member has been away.<\/span><\/li>\n<\/ul>\n<h3><b>Be clear on your stance against discrimination<\/b><\/h3>\n<p><span style=\"font-weight: 400;\">Although you legally can&#8217;t discriminate against your employees that do jury service, <\/span><b>they might still be worried that you will.<\/b><span style=\"font-weight: 400;\"> Make it clear in your policy that <\/span><b>managers discriminating against team members that go on jury duty will not be tolerated.<\/b><\/p>\n<p><span style=\"font-weight: 400;\">Adding a sentence or two about this in your policy <\/span><b>reassures<\/b><span style=\"font-weight: 400;\"> anyone that might be concerned about taking jury service for fear of losing their job down the line, or being passed over for projects or promotions.<\/span><\/p>\n<h3><b>Communicate what will happen during the employee\u2019s time off<\/b><\/h3>\n<p><span style=\"font-weight: 400;\">Let employees know that<\/span><b> their role will be covered or projects will be paused until they return.<\/b><span style=\"font-weight: 400;\"> This may differ from team to team or role to role, so you may have to make this section quite general.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Ensure that your team knows that deadlines will be extended if cover won&#8217;t be provided to <\/span><b>reduce the likelihood of stress<\/b><span style=\"font-weight: 400;\"> on their return to work. It may also be useful to ask your team member to write a<\/span> <span style=\"font-weight: 400;\">handover<\/span><span style=\"font-weight: 400;\"> like you would if they were going on annual leave.<\/span><\/p>\n<h3><b>Define the procedure if your employee is released from jury service<\/b><\/h3>\n<p><span style=\"font-weight: 400;\">While many people are excited at the thought of doing jury service, it&#8217;s often quite boring and there can be lots of waiting around. Sometimes jurors will turn up to the court only to be told they&#8217;re not required that day, and in that case, they can <\/span><b>come into work instead.<\/b><\/p>\n<p><span style=\"font-weight: 400;\">But consider what you would like your team members to do if they&#8217;ve been released early, but have been on a case in the morning. <\/span><b>Are they allowed the rest of the day off<\/b><span style=\"font-weight: 400;\"> if the case was emotionally draining or challenging? Whatever you decide, make sure your policy is clear.<\/span><\/p>\n<h3><b>Offer support for your employees that have been jurors<\/b><\/h3>\n<p><span style=\"font-weight: 400;\">Long or difficult trials, for example murder trials, can have a <\/span><b>serious effect on a person&#8217;s mental health.<\/b><span style=\"font-weight: 400;\"> Remind staff to lean on your<\/span><a href=\"https:\/\/factorialhr.co.uk\/blog\/employee-assistance-programme\/\"> <span style=\"font-weight: 400;\">Employee Assistance Programme (EAP)<\/span><\/a><span style=\"font-weight: 400;\"> for counselling or other wellbeing support if they have been affected by anything during the case.
