It dictates that:<\/span><\/p>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Employees <strong>can\u2019t work over 48 hours<\/strong> per week (on average), excluding annual leave, sick leave, parental\/adoptive leave and commute time (unless there is no fixed work location)<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Employers working within different industries must <strong>work out an employee\u2019s average weekly hours differently<\/strong>, although in most cases it is 4 months (prisons, tourist attractions and hospitals may differ)\u00a0<\/span><\/li>\n<\/ul>\n<p><span style=\"font-weight: 400;\">There are also stipulations surrounding rest periods in between working days. Employees must have<strong> over 11 hours of rest between working days<\/strong> <strong>as well as 24 hours not working within any 7-day period<\/strong>. This should be a Sunday unless their contract states otherwise. The reason must be outlined in this memo. The employer must then consider any health and safety issues that could arise as a result of this <\/span><i><span style=\"font-weight: 400;\">and <\/span><\/i><span style=\"font-weight: 400;\">enable you to take your outstanding break ASAP. If an employee doesn\u2019t accept this, they are not legally entitled to another offer.\u00a0<\/span><span style=\"font-weight: 400;\">\u00a0<\/span><\/p>\n<h2><b>Do employers need to keep records of working hours in Ireland?\u00a0<\/b><\/h2>\n<p><span style=\"font-weight: 400;\">Irish employers are <strong>legally obliged to keep accurate records of their employee&#8217;s working hours per day and week,<\/strong> plus any breaks and leave they\u2019ve taken. This can either be done electronically using <a href=\"https:\/\/factorialhr.co.uk\/time-attendance-signing\">time tracking software<\/a> and <a href=\"https:\/\/factorialhr.co.uk\/holidays-leaves-software\">leave management software<\/a>, or it can be done manually with an OWT1 form.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">These records must be easily understandable and made available to inspectors sent from the Workplace Relations Commission. They must also be <strong>kept for 3 full years<\/strong> (it is exempt from GDPR rules).\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">If records are not kept or are not made available to inspectors, <strong>employers can be fined up to \u20ac1,900<\/strong>. The employer will be held fully responsible, <\/span><i><span style=\"font-weight: 400;\">not <\/span><\/i><span style=\"font-weight: 400;\">the employee.\u00a0<\/span><\/p>\n<h2><b>What records must be kept<\/b> <b>of working hours in Ireland?\u00a0<\/b><\/h2>\n<p><span style=\"font-weight: 400;\">Irish law states that employers must keep the following records:\u00a0<\/span><\/p>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Employment contract copy\u00a0<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Personal details (Name, address, PPS number, overview of employee duties)\u00a0<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Days or hours of leave taken per week, including pay for these days\u00a0<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Days and hours worked per week (in total)<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Public holiday pay\u00a0<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Copy of working time record (e.g. timesheet or clock-in data)\u00a0<\/span><\/li>\n<\/ul>\n<p><span style=\"font-weight: 400;\">Who keeps the record of working hours must be agreed between the employee and employer.
