Since then, the UK&#8217;s approach has evolved: in October 2026, DSIT published its Blueprint for AI Regulation, centred on an AI Growth Lab of sectoral sandboxes, and the <a href=\"https:\/\/www.isms.online\/iso-42001\/does-the-eu-ai-act-apply-to-the-uk\/\" target=\"_blank\" rel=\"noopener\">Data (Use and Access) Act 2025 came into force in February 2026<\/a>. This framework outlines guiding principles such as safety, transparency, fairness, and accountability.<\/p>\n<p>However, UK companies are not legally required to adhere to these cross-sector principles, nor will they be penalised solely for not following them. Sector-specific regulators \u2013 including the FCA, ICO, and Ofcom \u2013 are now embedding these principles into their own binding guidance. This means non-compliance may carry indirect regulatory consequences depending on your industry.<\/p>\n<p>On the other hand, the <strong>EU AI Act sets a clear precedent<\/strong>. It is likely that the UK, along with other global countries, will follow suit by developing its own set of AI regulations. This new AI governance framework in HR means employers, CEOs, and business leaders will have to learn how to mitigate compliance risk when it comes to using AI in the workplace. They give employers flexibility with no legal enforcement when it comes to safe AI implementation. In contrast, the EU AI Act defines <strong>strict and specific regulations that will be enforced<\/strong>, and if businesses are not compliant, they will face heavy penalties.<\/p>\n<p>Additionally, the EU AI Act applies to companies outside the EU if they offer, distribute, or operate AI systems within the EU\u2013 or if the output of their AI system is used by individuals in the EU, regardless of where the business is headquartered. Brexit does not exempt UK organisations from this obligation.<\/p>\n<h2 id=\"what-is-the-eu-ai-act-and-who-does-it-apply-to\"><strong>What Is the EU AI Act and Who Does It Apply To?<\/strong><\/h2>\n<p>The <a href=\"https:\/\/artificialintelligenceact.eu\/ai-act-explorer\/\" target=\"_blank\" rel=\"noopener noreferrer\"><strong><u>EU AI Act<\/u><\/strong><\/a> is a set of rules to be adopted by the European member states with the intent to regulate artificial intelligence (AI). It aims to protect fundamental rights whilst providing room for science and AI innovation in research and industry, strengthening trust in AI systems.<\/p>\n<p>The law follows what the European Commission calls a risk-based approach, which means that AI systems are regulated with varying degrees of strictness depending on their potential risk to users and society.<\/p>\n<p>The official EU AI Act description can be found here:<\/p>\n<ul>\n<li><a href=\"https:\/\/eur-lex.europa.eu\/legal-content\/EN\/TXT\/PDF\/?uri=OJ:L_202401689\" target=\"_blank\" rel=\"noopener noreferrer\"><strong><u>AI Act EU PDF<\/u><\/strong><\/a> (English)<\/li>\n<\/ul>\n<h3><strong>Who will be affected by the EU AI Act?<\/strong><\/h3>\n<p>The EU AI Act imposes obligations on companies that provide AI applications. <a href=\"https:\/\/ai-act-law.eu\/article\/3\/\" target=\"_blank\" rel=\"noopener noreferrer\"><strong><u>Article 3 of the AI Regulation<\/u><\/strong><\/a> clearly defines who the law is aimed at:<\/p>\n<ul>\n<li><strong>Provider<\/strong>: Natural or legal persons, public authorities, or other bodies that develop or commission the development of a general-purpose AI system or model and place it on the market or put it into service under their own name or trademark. This is irrespective of whether this is done for a fee or free of charge.<\/li>\n<li><strong>Operators<\/strong>: Those actors who use an AI system on their own responsibility in a professional or business context.<\/li>\n<li><strong>Authorised representatives<\/strong>: Actors who have been authorised in writing by the provider to fulfil certain obligations under the AI Regulation on its behalf.<\/li>\n<li><strong>Importer<\/strong>: Natural or legal persons established in the EU who place an AI system bearing the name or trademark of a person established outside the EU on the Union market.<\/li>\n<li><strong>Distributor<\/strong>: Natural or legal persons in the supply chain who place an AI system on the EU market, other than suppliers or importers.<\/li>\n<\/ul>\n<p>The main idea of the regulation, which must be followed and implemented by the actors above, is that <strong>AI systems can pose risks to fundamental rights<\/strong>. Therefore, AI models are classified according to the risk they pose to fundamental rights. <strong>The higher the risk, the stricter the requirements actors must comply with\u2013<\/strong>\u00a0for example, regarding transparency, documentation, or oversight.<\/p>\n<h2 id=\"how-does-the-eu-ai-act-classify-ai-systems\"><strong>How Does the EU AI Act Classify AI Systems?<\/strong><\/h2>\n<p>Here is a summary of the key points of the EU AI Act and its risk-based approach:<\/p>\n<h3><strong>Risk-based classification of AI systems<\/strong><\/h3>\n<p>The EU classifies AI systems <strong>according to the risk they pose to people and society<\/strong>. These include, for example:<\/p>\n<ul>\n<li>Voice-controlled toys that encourage dangerous behaviour in children<\/li>\n<li>Social scoring systems that classify people based on certain characteristics (e.g., social behavior or socioeconomic status)<\/li>\n<li>Biometric real-time remote identification in public spaces, such as facial recognition<\/li>\n<\/ul>\n<p>According to the EU AI Act, these applications are considered <strong>an unacceptable risk<\/strong> to people and society.<\/p>\n<p><strong>High-risk AI systems:<\/strong><br \/>\nAI systems that pose a very high risk are permitted under certain conditions, such as <strong>testing, monitoring, and certification<\/strong>. They are divided into two main categories:<\/p>\n<ol>\n<li>AI systems in products (e.g., medical devices, vehicles, toys)<\/li>\n<li>AI systems in certain areas of society (e.g., critical infrastructure, education, law enforcement)<\/li>\n<\/ol>\n<p>All high-risk AI systems will be assessed throughout their life cycle. In addition, EU citizens will have the opportunity <strong>to file complaints about AI systems<\/strong>.<\/p>\n<ul>\n<li>Other risk classes are:\n<ul>\n<li><strong>Limited risk:<\/strong> A chatbot that provides customers with general product information. It does not provide safety-critical information, but users need to be aware that the answers are AI-generated.<\/li>\n<li><strong>Minimal risk:<\/strong> An AI application for spelling and grammar checking in text documents. It supports users but poses virtually no risk to health, safety, or fundamental rights.<\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<h3><strong>Transparency requirements<\/strong><\/h3>\n<p><strong>Transparency requirements<\/strong> apply to all AI systems and applications. For example, <strong>generative foundation models<\/strong> like ChatGPT are not classified as high-risk, but must still comply with <strong>transparency obligations<\/strong> and <strong>EU copyright law<\/strong>.<\/p>\n<p>That means:<\/p>\n<ul>\n<li><strong>Disclosure:<\/strong> It must be clearly stated that content was created using AI.<\/li>\n<li><strong>Avoiding illegal content:<\/strong> AI models must be designed in such a way that no illegal content can be generated.<\/li>\n<li><strong>Copyright Summary:<\/strong> When using training data, summaries of copyrighted content must be created and disclosed.<\/li>\n<\/ul>\n<p>National <strong>authorities<\/strong> should also <strong>provide test environments<\/strong> in which AI models can be tested in a controlled manner before they are widely deployed.<\/p>\n<h2 id=\"what-is-the-eu-ai-act-timeline-for-2026-and-beyond\"><strong>What Is the EU AI Act Timeline for 2026 and Beyond?<\/strong><\/h2>\n<p>Not all provisions of the AI Regulation will be implemented immediately. They are staggered and also differ between companies deploying new AI and those with existing solutions. The current timeline is as follows:<\/p>\n<ul>\n<li><strong> 12 July 2024:<\/strong> Publication of the AI Act (Regulation EU 2026\/1689) in the Official Journal of the EU.<\/li>\n<li><strong>1 August 2024:<\/strong> The regulation entered into force. A phased implementation period began.<\/li>\n<li><strong> 2 February 2025:<\/strong>\n<ul>\n<li>Ban on AI systems with <strong>unacceptable risk<\/strong> (e.g. social scoring, real-time biometric identification in public spaces) took effect.<\/li>\n<li>Mandatory <strong>AI literacy<\/strong> obligations (Article 4) came into force. Organisations must ensure staff working with AI systems have sufficient understanding of those systems.<\/li>\n<\/ul>\n<\/li>\n<li><strong> 2 August 2025:<\/strong>\n<ul>\n<li>Central governance rules and obligations for providers of <strong>GPAI models<\/strong> (general-purpose AI such as large language models) entered into application.<\/li>\n<\/ul>\n<\/li>\n<li><strong>2 August 2026:<\/strong>\n<ul>\n<li>Transparency obligations (Article 50) take effect for providers and deployers of limited-risk AI systems.<\/li>\n<li>Most governance and enforcement mechanisms become fully operational at national and EU level.<\/li>\n<li><strong>Following the Digital Omnibus agreement of 7 May 2026, the compliance deadline for standalone high-risk AI systems (Annex III \u2014 including <a href=\"https:\/\/factorialhr.co.uk\/blog\/ai-in-hr-understanding-ais-role-in-the-workplace\/\" target=\"_self\" rel=\"noopener\">AI in human resources<\/a>, recruitment, and critical infrastructure) was extended from August 2026 to 2 December 2027, according to the EU Council.<\/strong><\/li>\n<li><strong>Grandfathering:<\/strong> High-risk AI systems put into operation before the applicable deadline do not have to implement the new rules immediately. This applies as long as <strong>no significant changes<\/strong> are made.<\/li>\n<\/ul>\n<\/li>\n<li><strong>2 December 2027:<\/strong>\n<ul>\n<li>Full compliance required for standalone high-risk AI systems listed in <strong>Annex III<\/strong> (e.g. AI used in employment, recruitment, credit scoring, law enforcement).<\/li>\n<\/ul>\n<\/li>\n<li><strong> 2 August 2028:<\/strong>\n<ul>\n<li>Full application of the law for high-risk AI systems listed in <strong>Annex I<\/strong> that are embedded in regulated products (e.g. medical devices, machinery, toys).<\/li>\n<\/ul>\n<\/li>\n<li><strong> 31 December 2030:<\/strong>\n<ul>\n<li><strong>Extended transition period<\/strong> for certain large public authority IT systems.<\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<p>The EU AI Act&#8217;s penalty structure is amongst the most stringent in EU digital regulation. Violations of prohibited AI practices (Article 5) carry fines of up to \u20ac35 million or 7% of worldwide annual turnover \u2013 whichever is higher \u2013 exceeding GDPR&#8217;s maximum of \u20ac20 million or 4% of turnover. Non-compliance with high-risk AI system obligations carries fines of up to \u20ac15 million or 3% of worldwide annual turnover, whilst supplying incorrect or misleading information to authorities can result in fines of up to \u20ac7.5 million or 1% of turnover.<\/p>\n<p>The competent authorities and regulations on sanctions and fines still need to be implemented into national law.<\/p>\n<h2 id=\"what-is-the-impact-of-the-eu-ai-act-on-employers\">What Is the Impact of the EU AI Act on Employers?<\/h2>\n<p>As mentioned, the EU AI Act imposes regulations on companies that develop, operate, or distribute AI applications within the EU. For companies, this means they must have an AI governance framework in place to ensure compliance:<\/p>\n<ul>\n<li><strong>Risk assessment:<\/strong> You must assess which risk category your AI systems fall into (unacceptable risk, high risk, limited risk, minimal risk). This applies to all AI model operators.<\/li>\n<li><strong>Compliance obligations:<\/strong> Depending on the risk category, requirements such as transparency, technical documentation, certification, and reporting of serious incidents must be met. Operators of limited-risk AI systems, for example, only need <strong>to indicate that they are AI systems<\/strong>.<\/li>\n<li><strong>Training:<\/strong> Employees must be trained in the safe and legally compliant use of AI in accordance with <strong>AI Literacy. Even more, AI tools used during the recruitment process have saved teams time, money, and effort by creating job descriptions, centralising candidate information, and sorting through CVs. Such systems must meet EU AI Act compliance requirements by 2 December 2027 for standalone high-risk applications (including AI used in recruitment and HR decision-making), following the Digital Omnibus agreement of May 2026. Your HR team will have to audit their AI recruitment software to ensure they comply with transparency requirements.<\/p>\n<p>Moreover, HR technology and other advanced digital tools used in the EU must demonstrate fairness, transparency, and safety, and deployers of high-risk AI systems are required under Article 26 to conduct a Fundamental Rights Impact Assessment (FRIA) before deployment. In addition, HR leaders will need to prepare their team for AI literacy training. This protects users from falling victim to malicious AI threats or spam. The scale of this challenge is significant: according to DSIT&#8217;s AI Adoption Research, <a href=\"https:\/\/www.gov.uk\/government\/publications\/ai-adoption-research\/ai-adoption-research\" target=\"_blank\" rel=\"noopener\">60% of UK businesses cited limited AI skills and expertise as a key barrier to adoption, whilst large firms (250+ employees) reached 36% AI adoption compared with just 14% amongst micro-businesses<\/a>.<\/p>\n<h3>Why CEOs Should Pay Attention<\/h3>\n<p>Business leaders and CEOs will need to find a balance between innovation and compliance. When it comes to artificial intelligence, all systems used, created, or distributed within the EU must comply with the relevant tier of EU AI Act obligations. Prohibited practices have been enforceable since February 2026, GPAI obligations have been in force since August 2026, and high-risk system requirements will apply from December 2027.<\/p>\n<p>It is essential to stay informed and communicate any changes or adapt your processes accordingly to avoid costly penalties. Leaders who are proactive and implement policies to ensure compliance will be setting up their company for success in the long run.
