All employees who earn over \u00a3120 a week are eligible for SSP, which employers are obliged to pay if they are off work from illness or injury for up to 28 weeks.<\/p>\n<h3><b>Other Statutory Pay<\/b><\/h3>\n<p>Statutory Maternity Pay, Statutory Paternity Pay, Statutory Adoption Pay, Shared Parental Pay, and Parental Bereavement Pay are also increasing to \u00a3172.48 per week.<\/p>\n<p>You can find more information about<a href=\"https:\/\/www.gov.uk\/government\/collections\/statutory-pay\">\u00a0statutory pay<\/a>\u00a0and<a href=\"https:\/\/www.gov.uk\/government\/publications\/minimum-wage-rates-for-2023\">\u00a0minimum wage<\/a>\u00a0on the government website.<\/p>\n<h3><b>The King\u2019s Coronation<\/b><\/h3>\n<p>As with the Queen\u2019s Platinum Jubilee and funeral last year, the government has announced an extra bank holiday to celebrate King Charles III\u2019s coronation. The holiday is set to fall on Monday, 8th\u00a0May, but whether employers are obliged to honour it will depend on their \u2018Terms and Conditions of Employment\u2019.<\/p>\n<h3><b>Right to Work<\/b><\/h3>\n<p>The government has recently provided more details on the appropriate ways to check new employees\u2019 Right to Work. It specifies that employers are required to manually check the documents of all new employees.<\/p>\n<p><b>British and Irish citizens<\/b>\u00a0\u2013 Right to Work Check can be done using Identity Verification Technology (IDVT) through an Identity Document Scanner Provider (IDSP).<\/p>\n<p><b>Non-British and Irish citizens \u2013\u00a0<\/b>Require a Home Office Right to Work check.<\/p>\n<p>Employers can also conduct right-to-work checks via video link, but they must ensure they receive the original documentation and cannot accept scanned or faxed copies.<\/p>\n<h3><b>The Employment Bill<\/b><\/h3>\n<p>In 2019, the late Queen announced the Employment Bill in her annual speech. The bill was intended to further support workers and families with some significant employment law reforms. Unfortunately, the bill lost momentum during the pandemic, but recently some of the changes have appeared on private member bills.<\/p>\n<h3><b>These are some of the changes we might see this year:<\/b><\/h3>\n<ul>\n<li>\u00a0 \u00a0 \u00a0 \u00a0\u00a0The right to flexible working from day one.<\/li>\n<li>\u00a0 \u00a0 \u00a0 \u00a0\u00a0Neonatal leave and pay.<\/li>\n<li>\u00a0 \u00a0 \u00a0 \u00a0\u00a0Carer\u2019s leave.<\/li>\n<li>\u00a0 \u00a0 \u00a0 \u00a0\u00a0Protection against redundancy for pregnant employees.<\/li>\n<li>\u00a0 \u00a0 \u00a0 \u00a0\u00a0Allocation of tips in full.<\/li>\n<li>\u00a0 \u00a0 \u00a0 \u00a0\u00a0Placing a legal duty on employers to prevent sexual harassment in the workplace.<\/li>\n<\/ul>\n<h2><strong>UK Employment Laws Definition<\/strong><\/h2>\n<p>UK employment laws govern the relationship between an employer and an employee. They take into account existing employee rights and establish the work environment you must provide as an employer. This includes <a href=\"https:\/\/factorialhr.co.uk\/blog\/payslip-explained\/\" target=\"_blank\" rel=\"noopener noreferrer\">how much you pay<\/a> your employees, <a href=\"https:\/\/factorialhr.co.uk\/blog\/unpaid-leave\/\" target=\"_blank\" rel=\"noopener noreferrer\">leave and sick pay obligations<\/a>, and the provision of a <a href=\"https:\/\/factorialhr.co.uk\/blog\/laws-on-working-from-home\/\" target=\"_blank\" rel=\"noopener noreferrer\">safe working environment<\/a>. UK employment laws also regulate various HR processes, including <strong><a href=\"https:\/\/factorialhr.co.uk\/blog\/recruitment-process-policy\/\" target=\"_blank\" rel=\"noopener noreferrer\">hiring and recruitment<\/a>, promotions, trade unions, workplace grievances and <a href=\"https:\/\/factorialhr.co.uk\/blog\/severance-pay\/\" target=\"_blank\" rel=\"noopener noreferrer\">employment termination<\/a><\/strong>.<\/p>\n<p>It is important to have a firm grasp on all your legal obligations. You also need to make sure you are up to date with any changes as and when they are published by the government. The best way to do this is to conduct compliance audits on a monthly or annual basis. Failure to do so could result in a number of tribunal claims and put you at risk of penalties or even imprisonment.<\/p>\n<h2><strong>List of UK Employment Laws<\/strong><\/h2>\n<ul>\n<li><a href=\"https:\/\/www.legislation.gov.uk\/ukpga\/1996\/18\/contents\" target=\"_blank\" rel=\"noopener noreferrer\"><strong>Employment Rights Act 1996<\/strong><\/a>: covers the rights of employees relating to employment contracts, unfair dismissal, parental leave, and redundancy.<\/li>\n<li><a href=\"https:\/\/www.legislation.gov.uk\/ukpga\/1998\/39\/contents\" target=\"_blank\" rel=\"noopener noreferrer\"><strong>National Minimum Wage Act 1998<\/strong><\/a>: establishes the current NMW for employees in the UK. Reviewed regularly by the government in line with inflation.<\/li>\n<li><a href=\"https:\/\/www.legislation.gov.uk\/ukpga\/1999\/26\/contents\" target=\"_blank\" rel=\"noopener noreferrer\"><strong>Employment Relations Act 1999<\/strong><\/a>: establishes the right of employees to trade union recognition, derecognition, and industrial actions.<\/li>\n<li><a href=\"https:\/\/www.legislation.gov.uk\/uksi\/1999\/3312\/contents\/made\" target=\"_blank\" rel=\"noopener noreferrer\"><strong>The Maternity and Parental Leave etc. Regulations 1999<\/strong><\/a>: governs the rights of employees to time off for parental duties.<\/li>\n<li><a href=\"https:\/\/www.legislation.gov.uk\/uksi\/2000\/1551\/contents\/made\" target=\"_blank\" rel=\"noopener noreferrer\"><strong>Part-Time Workers (Prevention of Less Favourable Treatment) Regulations 2000<\/strong><\/a>: protects the rights of part-time workers so that they are entitled to the same treatment as full-time employees doing the same job.<\/li>\n<li><a href=\"https:\/\/www.legislation.gov.uk\/uksi\/2010\/93\/contents\/made\" target=\"_blank\" rel=\"noopener noreferrer\"><strong>Agency Workers Regulations 2010<\/strong><\/a>: prevents discrimination against agency workers relating to pay, holiday entitlements and safe working conditions.<\/li>\n<li><a href=\"https:\/\/www.legislation.gov.uk\/uksi\/2006\/246\/contents\/made\" target=\"_blank\" rel=\"noopener noreferrer\"><strong>Transfer of Undertakings (Protection of Employment) Regulations 2006<\/strong><\/a>: ensures employee rights during business transfers.<\/li>\n<\/ul>\n<h2><strong>Other Important Legislation in the UK<\/strong><\/h2>\n<p>To sum up, aside from UK employment laws, you also need to be aware of the following <strong>UK legislations<\/strong>:<\/p>\n<ul>\n<li><a href=\"https:\/\/www.legislation.gov.uk\/ukpga\/2010\/15\/contents\" target=\"_blank\" rel=\"noopener noreferrer\"><strong>Equality Act 2010<\/strong><\/a>: prevents discrimination in the workplace and the recruitment process. Forms the basis of anti-discrimination laws in the UK.<\/li>\n<li><a href=\"https:\/\/www.legislation.gov.uk\/ukpga\/2010\/23\/contents\" target=\"_blank\" rel=\"noopener noreferrer\"><strong>Bribery Act 2010<\/strong><\/a>: covers the criminal law relating to any act of bribery.<\/li>\n<li><a href=\"https:\/\/www.gov.uk\/data-protection\" target=\"_blank\" rel=\"noopener noreferrer\"><strong>Data Protection Act 2018<\/strong><\/a>: regulates how you store employee and customer data.<\/li>\n<li><a href=\"https:\/\/www.legislation.gov.uk\/uksi\/1998\/1833\/contents\/made\" target=\"_blank\" rel=\"noopener noreferrer\"><strong>Working Time Regulations 1998<\/strong><\/a>: covers a number of employee rights, including the right to a minimum of 5.6 weeks\u2019 paid annual leave each year and the 48-hour average working week restriction.<\/li>\n<li><a href=\"https:\/\/www.legislation.gov.uk\/ukpga\/1974\/37\/contents\" target=\"_blank\" rel=\"noopener noreferrer\"><strong>The Health and Safety at Work etc Act 1974<\/strong><\/a>: ensures the protection of employee health, safety and welfare in the workplace.<\/li>\n<\/ul>\n<p>Finally, you also need to be aware of any <a href=\"https:\/\/www.cipd.co.uk\/knowledge\/fundamentals\/emp-law\/about\/legislation-updates#gref\" target=\"_blank\" rel=\"noopener noreferrer\">upcoming changes<\/a> to UK employment laws. For example, an upcoming <strong>new employment bill<\/strong> will bring a number of changes to current employment law. Firstly, there will be <strong>a new right to request a more predictable and stable contract<\/strong> after 26 weeks\u2019 service (aim at zero-hours employees). Other aspects including <strong>Brexit laws<\/strong>, <a href=\"https:\/\/www.gov.uk\/topic\/business-tax\/ir35\" target=\"_blank\" rel=\"noopener noreferrer\"><strong>IR35<\/strong><\/a> latest news (off-payroll working) and changes to immigration law UK also need to be considered.<\/p>\n<h2>Employment Law FAQs<\/h2>\n<h3><strong>What is an Employment Contract?<\/strong><\/h3>\n<p>An employment contract is an agreement between an employer and employee, outlining the latter\u2019s <strong>terms of employment<\/strong>. In other words, it forms the basis of the legal relationship between both parties. An employment contract contains a number of <strong>rights and obligations<\/strong>. These include <strong>statutory obligations<\/strong> (such as the right to be paid the <strong>National Minimum Wage<\/strong> and the right to<strong> paid holidays<\/strong>) and any additional rights granted by the employer.<\/p>\n<p>Although usually formalised in writing, UK law states that, under certain circumstances, a verbal agreement constitutes an employment contract (more common in smaller, less formal companies).
