Perhaps circumstances within their company have changed, or perhaps the offer was dependent on requirements that the candidate has failed to meet. Either way, having a job offer withdrawn can be disappointing for the applicant. This makes <\/span>the process of rescinding the offer a delicate one<span style=\"font-weight: 400;\">. However, the answer is more nuanced if the candidate has already<\/span> <span style=\"font-weight: 400;\">accepted.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">If the candidate has <\/span><b>accepted the job offer and it is conditional, you can rescind the offer <\/b><span style=\"font-weight: 400;\">if it later becomes clear that they don\u2019t meet certain criteria. On the other hand, if the candidate has accepted the job offer and <\/span><b>it is unconditional, an employer cannot withdraw it as the employment contract has already begun. <\/b><span style=\"font-weight: 400;\">More on both of these instances below.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">If a job offer is withdrawn once the employment contract is legally binding, this is no longer referred to as an offer withdrawal. <\/span><b>This would be defined as a \u2018dismissal\u2019 <\/b><span style=\"font-weight: 400;\">and therefore equates to giving an employee notice of termination. In these instances, employers are<\/span><b> legally required to pay the amount that their notice period would have been worth<\/b><span style=\"font-weight: 400;\">. If this amount hasn\u2019t been documented anywhere, you can use the legal minimum UK notice period of a week.\u00a0<\/span><\/p>\n<h2><b><a id=\"withdrawing\"><\/a>Withdrawing an Offer of Employment<\/b><\/h2>\n<h3><b>Conditional Job Offer\u00a0<\/b><\/h3>\n<p><span style=\"font-weight: 400;\">This is any offer of employment that is<\/span><b> dependent on a candidate meeting specific conditions<\/b><span style=\"font-weight: 400;\">. In other words, the job offer is not final and the employment contract has not begun until the candidate has passed these <\/span><a href=\"https:\/\/factorialhr.co.uk\/blog\/employee-background-checks\/\"><span style=\"font-weight: 400;\">background checks<\/span><\/a><span style=\"font-weight: 400;\">. Examples of this might be:\u00a0<\/span><\/p>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><a href=\"https:\/\/factorialhr.co.uk\/blog\/job-reference-letter-employee\/\"><b>Reference<\/b><\/a><b> checks <\/b><span style=\"font-weight: 400;\">revealing misinformation was given about previous employment, or references aren\u2019t legitimate.\u00a0<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><b>Criminal record check<\/b><span style=\"font-weight: 400;\"> doesn\u2019t come back clean which is at odds with the candidate\u2019s application.\u00a0<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Research into <\/span><b>academic history<\/b><span style=\"font-weight: 400;\"> and qualifications doesn\u2019t match information the candidate provided.\u00a0<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><b>Right to work checks<\/b><span style=\"font-weight: 400;\"> reveal an issue with citizenship or visa type.\u00a0<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><b>Medical history<\/b><span style=\"font-weight: 400;\"> shows a candidate is unfit to fulfil the role.\u00a0<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><b>DBS check<\/b><span style=\"font-weight: 400;\"> reveals a candidate is unfit for the role.\u00a0<\/span><\/li>\n<\/ul>\n<p><span style=\"font-weight: 400;\">An offer <\/span><b>withdrawal based on any of those reasons is legitimate <\/b><span style=\"font-weight: 400;\">and means you don\u2019t need to pay any compensation.\u00a0<\/span><\/p>\n<h3><b>Unconditional Job Offer\u00a0<\/b><\/h3>\n<p><span style=\"font-weight: 400;\">In some instances, an employer might offer an applicant the job <\/span><b>regardless of any criteria being met.<\/b><span style=\"font-weight: 400;\"> This type of employment contract begins from the moment of acceptance. It is legally binding from then on, whether it is verbal or written. For this reason, <\/span><b>withdrawing an offer of this kind would be considered a breach of contract.\u00a0<\/b><\/p>\n<p><span style=\"font-weight: 400;\">For employers, the only other possibility here is being transparent with the candidate in the hopes that they will step back. You have every right to <\/span><b>speak with the candidate about rescinding the job offer.\u00a0<\/b><\/p>\n<p><span style=\"font-weight: 400;\">Although they don\u2019t have a legal obligation to accept your request, you might be able to mediate your way through the situation. <\/span><b>Communicate the honest reasons behind the offer withdrawal. <\/b><span style=\"font-weight: 400;\">Maybe your company has had budgeting issues or is undergoing an unexpected restructuring. Or maybe the applicant has since displayed behaviour that you\u2019re unsure about.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Whatever the reason, convey that you understand how difficult this might be for them. Perhaps <\/span><b>even send an official letter or email detailing this discussion <\/b><span style=\"font-weight: 400;\">(you can find a template below). Put simply, these are <\/span><b>qualities that cannot factor into your hiring decisions. <\/b><span style=\"font-weight: 400;\">These include:\u00a0<\/span><\/p>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Age<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Disability<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Gender reassignment<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Marriage and civil partnership<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Pregnancy and maternity<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Race<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Religion or belief<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Sex<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Sexual orientation.\u00a0<\/span><\/li>\n<\/ul>\n<p><span style=\"font-weight: 400;\">Basing the withdrawal of an offer of employment on any of these characteristics would be discrimination. <\/span><b>Doing so is therefore punishable by law.<\/b><span style=\"font-weight: 400;\">\u00a0<\/span><\/p>\n<h2><b><a id=\"howto\"><\/a>How to Withdraw an Offer of Employment\u00a0<\/b><\/h2>\n<p><span style=\"font-weight: 400;\">You might want to<\/span><b> follow up an offer withdrawal with a letter or email<\/b><span style=\"font-weight: 400;\">. Cementing your conversation in writing avoids potential confusion and could help to clarify any details. It also gives you an opportunity to <\/span><b>outline the reasons behind the offer withdrawal and prove that it was not a discriminatory decision.<\/b><span style=\"font-weight: 400;\"> This isn\u2019t just about covering your back. Ultimately, we are rescinding the offer due to [reason for offer withdrawal]. As the offer of employment was dependent on this condition being met, the employment contract has not yet begun. This also means that [company name] is not legally obligated to compensate you for this decision.\u00a0<\/span><\/i><\/p>\n<p><i><span style=\"font-weight: 400;\">We hope you are able to find a position that better suits you and wish you the best of luck in your search.\u00a0<\/span><\/i><\/p>\n<p><i><span style=\"font-weight: 400;\">Of course, don\u2019t hesitate to contact [HR manager\u2019s name] at [HR manager\u2019s email address] if you would like to discuss this further or have any questions about the decision.\u00a0<\/span><\/i><\/p>\n<p><i><span style=\"font-weight: 400;\">Kind regards,\u00a0<\/span><\/i><\/p>\n<p><i><span style=\"font-weight: 400;\">[Your name]<\/span><\/i><\/p>\n<p><i><span style=\"font-weight: 400;\">[Your job title]<\/span><\/i><\/p>\n<h2><b><a id=\"what\"><\/a>What to Do If Your Job Offer is Withdrawn\u00a0<\/b><\/h2>\n<p><span style=\"font-weight: 400;\">As a candidate, having your employment offer withdrawn can be understandably frustrating and disappointing.\u00a0 If you don\u2019t believe the employer\u2019s reasoning was fair, or you have any other issues with how the job offer was withdrawn, you have options.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Firstly, you can<\/span><b> reach out to the hiring manager to ask for more details<\/b><span style=\"font-weight: 400;\"> about the decision. Why was the job offer withdrawn? Which criteria did you not meet?
